These Terms and Conditions (“Terms”) govern the provision of photography services, the purchase of gift vouchers, and the use of the website operated by Fotkaplus Limited (trading as Fotkaplus Photography).

By booking a session, purchasing a gift voucher, or using our website, you agree to be bound by these Terms. Please read them carefully before proceeding. If you do not agree to these Terms, please do not book a session or use our services.
2. Our Services
Fotkaplus Photography provides professional studio photography services from our premises at 13 South Charlotte Street, Edinburgh. Our services include (but are not limited to) family portraits, makeover experiences, corporate headshots, kids and newborn sessions, maternity photography, boudoir photography, and passport and ID photographs.
Certain sessions (such as the Makeover Experience) include professional hair and makeup services provided in conjunction with our affiliated sister studio, Hello Beauty Salon. Where this is the case, it will be made clear at the time of booking.
3. Bookings
3.1 How to Book
Sessions can be booked online through our website (powered by Timely), by telephone, or by email. All bookings are subject to availability.
3.2 Payment
Full payment is required at the time of booking. Payments are processed securely through our booking platform, Timely. We accept major credit and debit cards. Payment must be received before your booking is confirmed.
3.3 Booking Confirmation
Once payment has been processed, you will receive a booking confirmation by email. This confirmation constitutes a binding agreement between you and Fotkaplus Limited, subject to these Terms.
3.4 Accuracy of Information
You are responsible for providing accurate and complete information at the time of booking, including the correct session type, number of attendees, and any special requirements. If you are unsure which session type is appropriate, please contact us before booking.
4. Cancellation and Rescheduling
4.1 Cancellation by You
We require a minimum of 48 hours' notice to cancel or reschedule a booking. Cancellations or rescheduling requests received with at least 48 hours' notice will be accommodated wherever possible, and we will offer an alternative date or a studio credit for use within 12 months.
Cancellations made with less than 48 hours' notice, or failure to attend your session without prior notice (“no-show”), will result in forfeiture of the session fee. No refund will be issued in these circumstances.
4.2 Cancellation by Us
In the unlikely event that we need to cancel or reschedule your session (for example, due to photographer illness, equipment failure, or circumstances beyond our control), we will notify you as soon as possible and offer an alternative date at no additional cost. If no suitable alternative can be arranged, a full refund will be issued.
4.3 Your Statutory Rights
These cancellation terms do not affect your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you book online and wish to cancel within the 14-day cooling-off period before your session date, you may be entitled to a full refund. Please contact us to discuss.
5. Your Studio Session
5.1 Arrival and Duration
Please arrive promptly at the scheduled time. Sessions typically last between 1 and 2 hours depending on the session type. Late arrival may reduce the available session time; we are unable to extend sessions that are delayed due to late arrival if another booking follows.
5.2 Who May Attend
You are welcome to bring a companion to your session for support or company. For family sessions, all attendees should be listed at the time of booking where possible. Children under 16 must be accompanied by a parent or legal guardian at all times.
5.3 Health and Safety
Our studio is a safe, clean, and professional working environment. For newborn sessions, we take particular care with hygiene, temperature, and handling. Please inform us in advance of any allergies, mobility requirements, or health conditions that may be relevant to your session so that we can make appropriate arrangements.
5.4 Conduct
We reserve the right to terminate a session early if any attendee behaves in a manner that is abusive, threatening, or disruptive to our staff or other clients. In such circumstances, no refund will be offered.
6. Image Viewing, Selection, and Delivery
The image viewing and delivery process differs by session type. The number of final images included in your package is determined by the session type and package you have purchased, as communicated at the time of booking.
6.1 Studio Sessions (Makeover, Maternity, Boudoir, Kids & Newborn, Family Portrait)
Following your session, you will be invited to return to our studio for a personal viewing appointment, typically scheduled at least one week after your shoot. At the viewing, you will be presented with a curated selection of fully retouched final images — the best photograph from each pose, selected by our team. You will then choose the images you wish to keep from the number included in your purchased package. Additional images beyond your package allocation are available for purchase at that time.
Once your selection is confirmed, your final images will be delivered within 1 to 2 working days via a secure, private online gallery hosted by our gallery partner (currently Pixieset). Your gallery will also include the option to use any print credits included in your package and to order physical products directly.
6.2 Corporate Headshots
For corporate headshot sessions, the image review takes place on the same day as your session. Immediately after shooting, we will sit with you and review the unedited images together, allowing you to select the images included in your package. Once your selection is confirmed, your professionally retouched final images will be delivered within 5 working days via secure online gallery.
6.3 Passport and ID Photographs
Printed passport and ID photographs are produced and handed to you during your session. Where digital files are included or requested, they will be delivered by email, pre-sized to the correct dimensions and specifications required by the relevant authority or standard.
6.4 Retouching
All final images (excluding passport and ID photographs) undergo professional colour grading and retouching as standard. This is included in your session price at no extra cost. Retouching is carried out at our discretion to ensure a consistent, high-quality result. We do not offer clients the ability to direct or approve individual retouching decisions.
6.5 Gallery Hosting and Storage
Your online gallery is hosted by our gallery delivery partner (currently Pixieset). We aim to keep your gallery available for as long as reasonably practicable; however, continued availability is subject to the ongoing operation of the third-party gallery service. We recommend that you download your images promptly upon receiving your gallery link.
6.6 Physical Products and Print Credits
Where your package includes print credits or you wish to order physical products (prints, canvases, albums), these can be ordered directly through your online gallery. Product pricing, specifications, and delivery timeframes are displayed within the gallery at the time of ordering.
7. Copyright and Image Licensing
7.1 Ownership
All photographs taken during your session remain the copyright of Fotkaplus Limited. Copyright is not transferred to the client.
7.2 Personal Licence
Upon full payment, you are granted a non-exclusive, non-transferable, personal licence to use your final retouched images for the following purposes:
- Personal use (printing, framing, sharing with family and friends)
- Personal social media use (e.g. profile pictures, personal posts)
- Professional use of corporate headshots (e.g. LinkedIn, company websites, press releases) where the session was booked for that purpose
7.3 Restrictions
You may not:
- Sell, sub-license, or commercially distribute the images without our prior written consent.
- Edit, crop, filter, or otherwise alter the images in a way that misrepresents the quality of our work or removes our watermark (where applied).
- Submit the images to competitions, publications, or stock photography libraries without our prior written consent.
- Use the images for any unlawful purpose.
7.4 Credit and Attribution
We appreciate (but do not require) a credit or tag when you share your images on social media: @fotkaplus_edinburgh_studio.
8. Use of Images for Marketing and Portfolio
8.1 Portfolio and Promotional Use
By booking a session with Fotkaplus Photography, you grant us a non-exclusive, royalty-free licence to use photographs from your session for our own marketing, portfolio, website, social media, and promotional purposes. This licence is ongoing and is not limited in duration.
8.2 Opt-Out
You may withdraw your consent for marketing use of your images at any time by notifying us in writing at info@fotkaplus.co.uk. Upon receiving your request, we will remove your images from our active marketing materials within a reasonable timeframe. We cannot, however, recall printed materials, third-party publications, or cached versions of online content produced or distributed prior to your request.
8.3 Boudoir and Sensitive Sessions
Photographs from boudoir sessions will never be used for portfolio or marketing purposes without your separate, explicit written consent. This is requested independently and is never assumed as part of the general booking Terms.
8.4 Children
Images of children will only be used for marketing with the express consent of the parent or legal guardian who booked and attended the session. Parents and guardians may withdraw this consent at any time.
9. Gift Vouchers
9.1 Purchase and Delivery
Gift vouchers are available for purchase through our website (powered by Timely) or by telephone. Vouchers are delivered digitally by email upon confirmation of payment.
9.2 Validity
Gift vouchers are valid for 12 months from the date of purchase. Expired vouchers cannot be redeemed, extended, or refunded.
9.3 Redemption
Vouchers may be redeemed against any studio session type offered by Fotkaplus Photography at the time of redemption. The voucher holder is responsible for booking their session within the validity period.
9.4 Non-Refundable and Non-Transferable
Gift vouchers are non-refundable and non-transferable. They cannot be exchanged for cash, combined with other promotions or discounts, or applied retrospectively to a session already paid for separately.
9.5 Lost Vouchers
Fotkaplus Photography is not responsible for lost, stolen, or deleted voucher confirmation emails. Please retain your confirmation email securely.
10. Passport and ID Photographs
Passport and ID photographs are taken in compliance with the requirements of the UK Passport Office, DVLA, and relevant embassies. While we take every care to produce compliant photographs, we cannot guarantee acceptance by any specific authority, as requirements may change or be applied at the discretion of the issuing body.
11. Liability
11.1 Our Liability to You
We will perform our services with reasonable care and skill in accordance with the Consumer Rights Act 2015. If we fail to do so, we will use reasonable efforts to remedy the issue, which may include offering a re-shoot or partial refund at our discretion.
11.2 Limitations
To the fullest extent permitted by law:
- Our total liability to you in connection with any session shall not exceed the total amount paid by you for that session.
- We are not liable for any indirect, consequential, or incidental losses arising from the use of our services.
- We are not liable for any loss or damage to personal property brought into the studio, except where caused by our negligence.
11.3 Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including (but not limited to) severe weather, power failure, fire, flood, pandemic, or government action.
11.4 Nothing in These Terms
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

We are committed to providing an excellent experience for every client. If you are dissatisfied with any aspect of our service, please contact us at info@fotkaplus.co.uk or call +44 131 210 0145 within 14 days of your session, and we will do our best to resolve the matter promptly.
13. Website Use
13.1 Intellectual Property
All content on our website — including text, images, graphics, logos, and design — is the property of Fotkaplus Limited or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content from our website without our prior written consent.
13.2 Accuracy
We make every effort to ensure that the information on our website is accurate and up to date. However, we do not warrant that the content is error-free and reserve the right to make changes at any time without notice.

Our website may contain links to third-party websites for your convenience. We do not endorse or accept any responsibility for the content, privacy practices, or availability of these external sites.

These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
